Since this action is one that is based upon negligence, the scenario will be analyzed using the elements of negligence ââ¬â duty, breach, causation and damages. Duty The first element that must be examined in this action, and any other negligence action, is duty. As far as duty goes, there does not need to be privity between the parties ââ¬â anybody who might be harmed because of the actions of the person causing the negligence is owed a duty, according to Donoghue v. Stevenson.1 This is particularly true when the harm is foreseeable.2 Therefore, if a person is reasonable, and is driving reasonably, then the harm cannot be said to be foreseeable. This would negate a person's duty. Whereas, previously, in English law, there must be some kind of privity between the tortfeasor and the victim, in that the victim an d the tortfeasor must have had some kind of prior relationship, the landmark case of Donoghue v. Stevenson3 altered this. In Donoghue v. Stevenson, the plaintiff, Donoghue, became ill after drinking ginger beer which had a slug in it. The justice in Donoghue proclaimed that individuals owed a duty to anybody who might be affected by their actions. Another case, Caparo v. Dickman4 states that the duty of care can be explained threefold - that the harm was reasonably foreseeable, that there was a relationship of proximity between the tortfeasor and the victim, and that it would be fair, reasonable and just to impose liability. So, as in the case of Overseas Tankship (UK) Ltd v Morts Dock and Engineering Co Ltd5, the defendants were not held negligent for a fire which broke out on the water, even though they knew that there was oil slipping below the dock onto the water and the defendants could not reasonably foresee that water would ignite. Moreover, proximity is also an issue, becaus e the harm caused must be proximate to the tortfeasor - Palsgraf v. Long Island Railroad Co.,6 is a case where there was not proximate cause between negligence on one end and an unforseeable victim on the other. In that case, the defendant was helping a woman onto a train and this woman had fireworks which exploded. This caused scales to fall on a distant bystander, and the court decided that the distant bystanderââ¬â¢s injuries were not proximately caused by the defendantââ¬â¢s actions. On this ground, the client would prevail, because he acted reasonably in his driving, therefore, there was not a duty to Sheila, as the injury was not foreseeable. On the other hand, since he left 10 minutes late,he might have had a duty if there was an issue to where her brain injuries would have occurred with a ten minute delay. Breach Breach is the next element that needs to be looked at. Again, foreseeability is the key to a breach of a duty. The injury that occurs must be foreseeable.7 If the injury that occurred was not foreseeable, then there would not be a breach of duty.8 Again, this would rest upon whether or not the person was acting

Our report is about the Energy Drinks of Bangladesh. In this report we have explained and analyzed how some of the five top selling energy drink companies are operating in Bangladesh. Energy drinks are becoming a major part of the beverage industry due to the rapid increase of their market competition and consumer awareness. In Bangladesh, Tiger and Speed are the most famous amongst all other energy drinks. Most of the energy drink companies act and carry out their marketing strategies in similar ways. More innovative steps are required to improve their market share. The goal of this report is to find out about the present condition of energy drink market in Bangladesh, major competitors we are likely going to face and how we are going to overcome the challenges in the market when we will launch a new energy drink named ââ¬ËSpiritââ¬â¢. With the use of effective marketing mix and other strategies we are going to target the young people of Bangladesh to sell our product. We have done a clear competitive analysis to take advantage of the weaknesses of our competitors and opportunities of the market. It includes 3 main levels: Core Customer Value, Actual Product and Augmented Product. Core Customer Value ââ¬â The first thing that comes to everyoneââ¬â¢s mind when they talk about energy drink is ââ¬Ësource of powerââ¬â¢. In Bangladesh, all of the energy drink companies basically have the same core customer value, which is mainly about replenishing the energy of their customers through providing them with their energy drinks. However, different brands use different mottos to establish their customer value. For example: Sharkââ¬â¢s motto says, ââ¬Å"Real Energy, Real Powerâ⬠; in other case Speedââ¬â¢s motto says, ââ¬Å"Heavy Energyâ⬠. This way each products motto varies from each other and creates a different view about the product in their customers mind. Speed, Tiger, Shark, Sting and Boost all maintain an informative and trendy labeling to help their customers to make the right choice. The five energy drink companies ââ¬â Speed, Tiger, Shark, Sting and Boost; all of them are between the introduction and growth stage of their product life cycle. At this stage they are only informing the customers about their product including their benefits. Basically all the companies are following the same way to promote their products and these are some of the most common media channels used by them for doing promotion ââ¬â television, radio, newspapers, magazines and internet. Target Group: Energy drink companies mainly target the major districts of Bangladesh. Here are some of the advertisement stories of the five energy drink companies ââ¬â 1. Speed In one of Speedââ¬â¢s advertisements, they have shown some guys were trying to get up on a bamboo for the whole day without getting tired. Their motto is ââ¬ËHeavy Energyââ¬â¢. In other words, they are using emotional appeal. In newspapers, they post a picture from the screen shot of their advertisements and use the same motto, so that people can get a clear brand knowledge. They do not have any brand ambassador for their product and they are constantly sending out the notion to their consumers how Speed can let them gain unlimited energy. 2. Shark There is an advertisement of Shark ââ¬Ë20 takay Dhakaââ¬â¢, they showed a guy kicked another person from Chittagong and sent him to Dhaka after having Shark energy drink. They are using the motto ââ¬ËReal Energy, Real Powerââ¬â¢. In their advertisements they use the rational appeal to attract customers. They have no brand ambassador, because they are not still going for intensive or aggressive promotion. 3. Sting -. In the television advertisement there was one young boy who went to a shooting spot with the hope of being a superstar. On that time one director was taking the shot of riding a motor cycle on that spot. Showing that the young boy moved forward to do that shot but the director did not allow him and insulted him that made the young boy very frustrated. After that the director was supposed to make that shot with the hero but unfortunately the hero failed to ride the motor cycle. Then the director asked the crowd who could do the shot. The first young boy showed up the courage and did that shot in a fantastic way. Everybody praised him a lot. They started celebrating the happiness together by dancing with sting energy drink. They were singing ââ¬Å"Sting, Sting, Sting ââ¬âUllasher Shuru Ekhaneiâ⬠. They are using rational appeal in their advertisements In the radio advertisement they play the same jingle. In newspaper the marketers use the picture of 250ml bottle of sting energy drink and write their jingle. They give the same ad in magazines too. In billboards and posters, the marketers add the picture in a big way that they use for newspaper and magazine. 4. Boost In one ad they have shown that a young guy, probably of age 20 was walking along the roadside, on the background rap music is going on (sign of young generation). The lyrics was talking about getting energy, confidence and success. The guy had his neck tattoed and wore a sunglass, showing the style of recent youth fashion. He went into a departmental store, went to the refrigerator, there were other drinks (e. g. red rooster and red bull); but he picked up BOOST, then he paid for it, got out, drank it and got himself recharged and the soundtrack was saying as if he could fly now. So this is one example of their rational advertisements. They have not used any brand ambassador yet for their product in Bangladesh, and these two advertisements are not even shown in Bangladeshi channels, they are only available in You tube. 5. Tiger The tiger energy drink has only one advertisement which is very popular. The brand ambassador Aiyub bachchu is the model for the advertisement. The advertisement showed that, when the popular singer Aiyub Bacchu attended a party, the audience requested him to sing a song. But at that time Aiyub Bacchu felt tired and bored. So he needed to recharge himself to get energy. So he took tiger and then sang a song with more power and energetic voice. In this way they try to attract customers by using the rational approach. They also do radio advertisement with the song of Aiyub Bacchu. In billboard advertisement they promote their motto ââ¬ËRecharge Yourselfââ¬â¢. Effect ââ¬â Different advertisements effectââ¬â¢s consumers differently. In general, all of these advertisements encourage people to buy their products. When people get satisfied with one product, they talk positive things about it, this way companies can enjoy the benefits of -word of mouth. Customers get to know through these advertisements how their everyday lives are going to be benefitted if they have these energy drinks. Personal selling: Personal selling is no longer considered as giving door to door service. It is a much wider concept nowadays. Companies not only their sell their product to the customers, they also build a loyal relationship with them. To keep on and for maintaining such a relation, companies must be ready to deal with different problems their customers have regarding their product. Unfortunately, none of these five energy drink companies do these in Bangladesh. They are more focused on advertising only. Sales promotion: In general, energy drink companies do not give any special discount on their product to boost their sales. Companies give incentives to their channel members to keep their product in the front line of their shelves, so that customers choose to have it by first looking at it. Sometimes they give energy drink on their own to the customers, because it make the customers feel the product is of high quality and that is why the salesman is offering it to them. Besides people generally do not look out for products those are kept behind the shelves, as it will be very time consuming. Advertisements do even contribute to generate the sales level sometimes. Though there are many other ways to promote sales, the energy drink companies mainly follow these two ways to carry out their sales promotion activity. Public Relation: To operate in this digital world it is very important for companies to maintain a good relation with both their internal and external publics, example ââ¬â shareholders, customers. Some of the energy drink companies arranges concerts and sponsors television shows to interact closely with their customers. Example ââ¬â last year Tiger organized one concert in Doha. Each of the five companies uses different and unique logos for their product. None of them are involved in doing conferences or giving press release. Buzz marketing is also a tool used by these companies to improve their relations with the general public and promote their product as well. Direct Marketing: Energy drink companies have their official websites, but their use is not very effective in Bangladesh. In huge shopping malls or in other areas, none of the energy drinks are available in vending machines. These products are not even sold by the companies directly over online or by using telephone. The only way they carry out direct marketing is through placing the advertisement videos in You Tube. The energy drink companies still lack good customer service, example ââ¬â no service or facilities provided to give complaints or to share ideas about the product face to face with the customers. Promotion Mix Strategy: The demand for energy drink is not yet very high in Bangladesh. So all the manufacturers of these five energy drink companies use the push strategy. Manufacturers contract with wholesalers or retailers to pass down their products to their final consumers and also to encourage customers to buy the products. Sometimes manufacturers give incentives to the channel members to promote their product as well. This new energy drink will hopefully win the hearts of our target customers and please them with the new taste and value of our product that we going to offer. This energy drink will not only make people active physically, it will also motivate them spiritually to move ahead in their lives with confidence. We will offer Spirit energy drink within the different territories of Bangladesh, like- Dhaka, Chittagong, Rajshahi, Barisal, Sylhet, Rangpur and Comilla. We will be selecting these territories because these are the biggest district of Bangladesh and most of the people live in these places. We will offer our product throughout every individual district, starting from the departmental stores to the small local and street stalls. We are offering Spirit both in urban and rural areas as well. In his book Primitive Culture, Edward Tylor (1871) defines culture that as complex whole which includes knowledge, morals, beliefs, art, law technology andà any other capabilities and habits acquired by man as a memberà of the society. Being human being communicative, interestingly, language reveals much more what we actually speak out, not only a means of communication. The Sapir Whorf hypothesis states that the structure of a language influencesà the ways in which its speakers conceptualize their worldà or otherwise affects their cognitive processes. The cultural worldview of a man is presented by the language and reflected through his responses in a specific period of time. Cultures are maintained from generation to generation and affected by geographical location and history of that nation as well as the interaction of that people over time. Simultaneously, language also develops to meet the need of communication of people. Therefore, it can be stated that yourà language can reveal many things about your identity. It can disclose your nationality, culture, religion, age, gender, level of education, socio-economic class or your profession. Mendoza-Denton (2002:475) definesà identity to mean the active negotiation of an individuals relationship with larger social constructs. It means that identityà is reflected in the language we use, our word choices in identifying ourselves as well as in the words we choose not to use. Language is part of ones identity. The relationship between language, culture and identity The Sapir Whorf Hypothesis In linguistics, the Sapir Whorf Hypothesis states that each language holds an own way to present its meaning that can not be understood by those belong to another language. Native languages are concerned to strongly affect peoples thinking. Whofianism is another popular name for this hypothesis and is often defined as having two versions: The strong version linguistic determinism thatà states that the language you speak determines the way that you will interpret the world around you. In this case, interlocutors think much of how to speak to best express their ideas and how to avoid misunderstanding caused by spoken words. For example, in Vietnamese culture, when visiting a newborn baby, we usually say that she/ he is very ugly to mean that the baby is so cute. Vietnamese do not use direct saying to compliment a newborn baby. In Western culture, questions about ages or marriage status are considered impolite. The weak version that linguistic categories (part of speech)à and usage influence thought and certain kinds of non-linguistic behaviour. The strong version of this hypothesis has been mostly discarded but the weak form of the hypothesis is generally accepted. Defintion of UG of Noam Chomsky (1957) also states that the human brain contains a limited set of rules for organizing language. Language is governed by a set of highly abstract principles that provide parameters which are given particular settings in different languages. This set of rules is known as universal grammar. Intercultural communication Intercultural communication generally refers to face to face interactions among people. It is a good idea to use title such as Mr Mrs or Dr along with a family name in a business discussion in some parts of Europe. The first name used without permission is considered direspectful. In Japanese culture, long pauses in a conversation are normal, especially after a question. They need time to think over it. However, in other cultures, it is comfortable if interlocutors keep silence in a dialogue, there will be someone to speak to end the silence. To work together without problems, people need to understand their differences. People belonging to diverse culture are still able to understand their language each other, though, there are the potential misunderstanding and disagreement. Learning about intercultural communication is a very good idea to reduce this risk. And a language teacher as a language messenger must realize this. Language as a core value and identity Mendoza-Denton (2002:475) definesà identity to mean the active negotiation of an individuals relationship with larger social constructs. These social constructs have been understood as comprising gender, ethnicity, and class following Gumprez (1982) in some of the earliest work on identity. Ones identity was understood as whom you were, and who we are or how we are seen by others may involve differing identities. According to Zimmerman (1998), there are three types of identity: Discourse identity which is revealed through particular discourse and presented by speakers, hearers. Situational identity which is revealed through the specific situation. For example, a person who is half Italian half French may want to identify with a particular ethnicity in some social situation. (e.g., attending a soccer game). This choice may even be crucial for his personal security. Transportable identity which applies across situations and discourse and includes such constructs as ethnic, gender, and age. I would like to mention my ideal woman- Hillary Clinton and her concession to Barack Obama in 2008. In order to successfully reposition herself from an opponent to a supporter of Obama, Clinton draws on several aspects of her transportable identity to stress the similarity between herself and Obama. Next to focusing on the fact that they are both Democrats, Americans and human beings, she zooms in on their membership of two powerless groups: namely that of women and African Americans. Both from a historical and a personal perspective, these two categorizations of herself and Obama are presented in a highly persuasive way and create unity between the two former opponents. A mans identity can disclose his nationality, culture, age, profession and socio economic class. Defined by the articleà Understanding Racism,à a defining feature of a persons identity, contributing to how they see themselves and the groups with which they identify. Culture may be broadly defined as the sum total of ways of living built up by a group of human beings, which is transmitted from one generation to another. This clearly shows the importance of language, culture, and heritage in forming and shaping ones personality. It means that once language, which is part of culture, the tool of self-definition in relationship to other nations is under controlled, that people will be truly colonized. Well understanding power of language will help students more motivated to learn the standard language as well as to selectively uncover what they take for granted and internalize as personal failure. Language Policy Language Policy is what a government does either officially through legislation, court decisions or policy to determine how languages are used cultivate language skills needed to meet national priorities or to establish the rights of individuals or groups to use and maintain languages (Wikipedia) In terms of this definition, an overview about the status of reality of teaching and learning English language in Viet Nam would be best to support this part of my writing. Since its open door policy in the mid 1980s, Viet Nam has welcomed many foreign organizations to invest and establish their business. As a result the demand for English increased greatly in all aspects The Government of Vietnam is devoted to developing English language skills on a long-term strategic basis to compete more effectively in international markets and thereby achieve sustainable economic growth. One of the biggest reflections to push this strategy is a project whose title is Teaching and Learning Foreign Languages in the National Education System, Period 2008-2020 by the Ministry of Education which was approved by Prime Minister. The authority promotes this project to obtain a result that, by 2020, the majority of young Vietnamese will be able to use English communicate confidently and be able to study and work in a multi-lingual and multi-cultural environment; thus the industrialisation and modernisation of the country will be contributed by the more dynamic and better integrated young Vietnamese people. Common knowledge in many other fields at school is a background and English as a secon language is a key to get success for the youth and the development of the country as well. In this setting, the implications for language teaching and policyà therefore vast and far reaching. Policy makers should specify their guidelines the teaching of culture in foreign language pedagogy. Curriculum should be implemented on the basis of being linguistically, culturally, and developmentally appropriate for students. A comparison between the target-language culture and the native language culture is essential to help learners avoid the mono-cultural view. As a teacher of language, one must be culturally awareà target language culture as well as the students, thus avoiding any cultural misinterpretations. CONCLUSION Language and culture are deeply related and dependent on each other. Language is formed by culture, while culture is influenced by language. Furthermore, language is not only an expression and a display of heritage and history, it is also the component of culture that makes it unique, and that creates a difference from one to another. Cultural identity is an important contributor to peoples wellbeing. Identifying with a particular culture helps people feel they belong and gives them a sense of security. However, strong cultural identity expressed in the wrong way can contribute to barriers between groups. And members of smaller cultural groups can feel excluded from society if others obstruct, or are intolerant of, their cultural practices. Peple in different cultures hold different way to view the world. As a language teacher, I now understand that it is very important to be aware of target language culture as well as the students, thus avoiding potential misinterpretations.

Gene Therapy and Its Effect on Cancer The era of scientific advancement in the twentieth century has encouraged several scientific fields to merge into a new, futuristic science called Biotechnology. One idea behind Biotechnical science is taking advantage of molecular biology. At the forefront of this advancement is gene therapy which " attempts to treat disease at its origin on the molecular level"(Kreeger,1996). "Essentially, this therapy deliberately introduces genes into the human cells to compensate for aberrant genes that cause genetic disease" (Beese, 1996). This therapy can be administered in two ways. One is germ-line therapy which not only treats the cells of that individual but these treated cells could be passed onto the individual's offspring. This type is the focus of much of the opposition of gene therapy itself because trials take many years and few results have proved conclusively safe for those treated and their children. The other type of therapy less opposed is the somatic cell approach that only aff ects the cells of the individual being treated. Cancer has recently been the target for several different types of somatic cell therapy and along with them come a set of controversial aspects that question its role in society. Cancer is an ever- increasing disease that affects all ages, sex and race. It has no preference for where it resides as it can be found in several organs and on several different tissues. Dreams and Racism in A Raisin In The Sun At most times, the American Dream resembles an ideological puzzle more than a fully realizable image. Within the confines of her fantastical, theatrical world Lorraine Hansberry attempts to fit a few of these pieces together and, in the process, ends up showing exactly how everything doesn't just snap-together all nicely. The problems in her play, A Raisin In The Sun, deal primarily with the basic nature of humans and their respected struggle's to "make it" in America. The story, for the most part, centers upon an African-American family, their dreams for the future and an insurance check coming in for death of the eldest man. Stirring into the mix later is the hugely oppressive, segregationist aspect of mid-twentieth century America. With highly oppressive external pressures, combined with conflicting ideas of happiness, the story centers on the ideological conflicts between characters. The largest conflicts result between Mama Younger and her son, Walter. Walter represents, apparently, all the things America instills in men; the desire to work hard and make a better life for his family than he had, the inability to be compassionate towards his family, an almost ignorant refusal to vary from his dream for the dreams of others. Hansberry centers here, it would seem, on the most negative aspects of "manhood". In fact, overridingly, men in this play are horrible creatures: George is uppity, aristocratic and a braggart (mentioning the curtain time in New York to a women who obviously has no idea about that type of thing simply places him, in his eyes, that much higher than her); Walter's friends are loud-mouth-know-it-all's (one of whom takes off with all the money th... ...r but, until the day he dies she will be his sister, and therefore he will always be somewhat proud of her. To me, this is an intricate human detail and evidence of Hansberry's supreme ability of crafting characters right out of real life. In the end I believe she is making the statement that the so-called American Dream is different for everyone; sort of a spiritual fingerprint of utopia. Being an African-American woman in the 40's and 50's probably had a large influence on the tone of this piece; as did being a severely closeted lesbian. Even though our respective upbringings couldn't be much more different, I fully agree with the stance she's taken. The table of America isn't level, thus causing the puzzle to shift and tilt uncontrollably. The pieces don't always fit and it is sad that so many people spend their entire lives trying to force them to work.
